Subclass 188

Subclass 188 visas are designed for business owners, entrepreneurs, and investors who wish to operate in Australia. Subclass 188 has multiple streams, which include:

  • Business Innovation and Investment (Provisional) visa (subclass 188) – Business Innovation stream

This temporary visa allows you to you operate a new or existing business in Australia. This visa requires nomination by the state or territory government.

This temporary visa requires you to be nominated by a State or Territory government agency to invest at least AUD2.5 million in Australia.

This provisional visa allows business individuals to be nominated by a State or Territory government agency or Austrade to invest at least AUD5 million that meets specific requirements and hold it during the visa validity.

This provisional visa enables Subclass 188 – Business Innovation Stream visa holders to extend their stay for up to 6, 7 or, 8 years after the date of grant of the original Business Innovation and Investment (Provisional) visa

This provisional visa enables Subclass 188 –Significant Investor stream holders to extend their stay in Australia for up to 4 more years.

This provisional visa enables individuals nominated by Austrade to invest at least AUD15 million in Australian investments and/or philanthropic contributions.

This visa allows for start-up and early-stage entrepreneurs who have secured a third-party funding agreement and a nomination from their state or territory government to stay in Australia to develop their concept and carry out entrepreneurial activities.

Business and Investment (Provisional) Visa Timeline

Augustine & Co. can assist with the whole process - from providing specialist legal advice, corresponding with state and territory officers for nomination, applying for expression of interest and visa application once invited, to addressing any specific requests by a case officer, until a decision is made on the visa application.

Step 1: Expression of Interest

Once we determine your eligibility and confirm that you are eligible to apply for a Subclass 188 visa, we will then assist you in lodging an Expression of Interest.

Step 2: Nomination

Once an expression of interest is submitted, we will assist in lodging a nomination application with your preferred state, or Austrade, for some applications. Relevant business plans/proposals that are of exceptional economic benefit to the State or Territory will need to be prepared prior to nomination. If a state or territory/Austrade nominates you, you will receive an invitation to apply for a Subclass 188 visa.

Step 2: Visa Application

The applicant is then required to apply for the Subclass 188 visa application within 60 days.

Holders of the Subclass 188 Business and Investment visa can continue living in Australia permanently by applying for a subclass 888 visa. Subclass 888 has multiple streams, which includes:

Covid-19 Concessions

Applicants for Subclass 888 visas must usually have been physically present in Australia for a least 1 year in the 2 years immediately before they apply.

During the COVID concession period which commenced on 1 February 2020, time spent overseas may be counted as being time spent in Australia if the applicant held one of the following visas:

  • Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation stream
  • Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation Extension stream

The first visa in the Business Innovation and Investment (Provisional) visa (subclass 188) in the Business Innovation stream must have been granted on or before 30 June 2019.

The new amendments provide concessions for Subclass 888 (Business Innovation and Investment (Permanent)) and Subclass 188 (Business Innovation and Investment (Provisional)) visa applicants and holders to assist those who are on a pathway from a provisional visa to a permanent visa, who have demonstrated a commitment to the Australian economy, and who have since been adversely affected by the restrictions imposed as a response to the COVID-19 pandemic.
